HUD is trying to craft a rule that can make a difference, but knock it down in court and not spark a huge political backlash. There are people who want HUD to be much more prescriptive about what kind of desegregatory or housing discrimination outcomes they want to see. The sympathetic argument to HUD is that the Obama-era rule was basically destroyed once things got so politicized.
