After transunion supreme court case, it really seemed like there wasn't a path forward. "I think tests are persuasive because you can actually have a way of measuring whether a plaintiff has satisfied the requirements" Will have to see if other circuits adopt it and if the supreme court is not very friendly to plaintiffs in any kind of civil suit.
