The Court's Decision in the Red Rego and Codyo Case
California has had previous decisions where the courts did not grant any compensation to people that were injured during the course of their martial arts instruction. In those cases they weren't satisfied that there was a degree of recklessness here that justified any award being granted. The court in this case recognized that yes injuries will happen and it's okay to push your student as an instructor because one of the big issues in that one was that the instructor was increasing the speed of the technique so is to make it more challenging to allow the student to get better.
