Is There a Comparative Negligence Clause?
The defendants, the administrators in this case, argued that the victim's claims were barred by the doctrine of comparative negligence. That's a legal term that means assign blame to two or more parties based on the degree of negligence each contributed to the incident. According to that logic, the student shared in the blame when the teacher sexually assaulted her. She had to deal with that victim blaming. There was plenty of it.
