The Politics of the Carbon Pipeline
In 2009, our legislature put in the language that CO2 pipelines could be deemed as common carrier along with natural gas oil transmission lines. So by them adding that language to our century code, it gives some of carbon solutions if deemed a common carrier line, the authority to utilize eminent domain. The public service commission can overrule these county commissions because the county self-passed similar language or similar ordinances. But it's ultimately up to the three people that sit on the public service commission. And one of them, mind you, had to recuse herself because she owns land words, this carbon's being sequestered.
