The Fifth Circuit's Decision to Stop an Abortion Drug From the Market
The Fifth Circuit Court of Appeals could be ruling at any time on whether or not it will halt a Texas judge's ruling to pull a common abortion drug off the shelves. In dueling court briefs, the Biden administration and the anti-abortion groups who originally brought the Texas case, both fought to convince the court to take their side. The DOJ and the drug manufacturer are asking the court to keep the pill available while the case is decided. Pharmaceutical companies filed a new brief backing the administration last night, warning that the ruling could have disastrous implications. Unless stayed, the district court's lawless opinion will empower any plaintiff to grind drug approvals to a halt, disrupting patients' access to critical medicines.
