What to Make of the 2023 NDAA and Consolidated Appropriations Act

The Lawfare Podcast

CHAPTER

Electoral Voting in 2020

The bill does a variety of things there are probably a little too technical to go into too much detail here but the main thing it does essentially is try and lock in the laws in place that states put in place governing the election and selection of electors prior to election day. It tries to curb the risk that some state legislature will try and step in after elections if it doesn't like the results and give its electoral votes  to another candidate. There may be constitutional arguments as to why that won't be entirely effective although there's some reason highlights of the bill even makes mention of this instead they're not trumped by either side.
