Mr Justice McDonald's said he found it intellectually repugnant to authorise a debt probation where the state was failing to abide by its own statutory obligations. Mr McFarland added: 'It is alarming, distressing and requires far more urgent attention than government seems to be giving' Do you think this will go anywhere? One could see a claim getting somewhere under article two or article three by the family,. But it's horrific that the judge even had to say that and imply that it has some merit as a potential argument in the future. And so it remains to be seen whether any further action is now taken to improve the situation. I suspect we're going to continue to see an increase
