Is This a Recorded Recollection Rule?
This is a recorded recollection exception to the hearsay rules. You don't plan out your direct thinking what somebody might ask in cross examination. It's almost as if you are reading rule 803 subpart five. So in other words, instead of asking someone, hey, didn't you write in this email that X, you would say, hey, did you ever tell me? Hey,did you ever talk to somebody? Yeah, and remind me,. My recollection in the question was kind of like, well, because you're not entering them into evidence, that's kind of different than saying, okay, you can just look at these notes.
