Thomas: There are two ways you can have a dormant commerce clause problem. First, states can't discriminate against interstate commerce. For example, California can't say you can only buy peaches from California farmers, but not peaches from Georgia farmers. The other potential problem is that states can't have laws that unduly burden interstate commerce.
