The State's Obligation to Prevent Child Abuse

Deschaney v. Winnebago County is a case about the state's obligation to prevent child abuse. The Department of Social Services had numerous warnings about his abuse, no action was taken. Eventually, the father beat the child to the point where he had severe brain damage. In 1988, this comes to the Supreme Court with the fundamental question being whether Joshua's 14th Amendment right to liberty had been infringed by the state's inaction here. And the Supreme Court in a six to three decision says that it has not.
