What Is a Right Not Corporated in the Bill of Rights?
The states get more and more democratic with less power. The fets are getting more power, and they're largely stuck in a very non democratic mould. Most recently we'e just had a unanimous jury verdict incorporation. We didn't have that through most of american history. You went to your state constitution in state courts. And you know, never the twain shall meet. It's really only the last decade or so where we have this dynamic where the federal courts aren't quite as innovative. An indeed cutting back likinarucho is 20 years away from happening. But we'll have God knows what may happen next.
