The Disparate Impact Theory
If you have a meritocratic standard or criminal law standard and it has a negative disparate impact on blacks, it must be a racist standard according to elite wisdom. The only allowable explanation for the lack of racial proportionality is racism. If our prison system has more than 13% black prisoners, it's a racist criminal law system. So that's what the disparate impact theory holds. But behind that, what I mean is the idea of equality of opportunity - but now the word equity is used in its place,.
