Fourth and Sixth Exceptions to a Wrongful Search
Under the consent exception, a suspect must have given their consent freely, voluntarily and intelligently. The officer cannot pull some one over for no reason and then conduct a valid warrantless search under the automobile exception. If two or more people share authority, any one of them may consent,. But the police cannot search private areas that only the non-consenting person has authority to give.
