Clark: I'm observing all sorts of instances of governors exercising powers that it seems to me they don't have. There's no one size fits all answer and we have to sort of break this down policy by policy, he says. In some cases, it's legitimate for the governor to be doing some of these things, Clark adds. But if it's at least arguably within the bounds of potentially a valid policy, it generally is going to come down to this question; Is the infringement of liberty reasonable in the overall context of what's going on?
