The Role of the State in the Constitution
Every time you have a recognition of the right to property, an amendment happens. So it seems that the constitution becomes less one that values property and elevates the role of the state increasingly. The court sees itself as a participant in the promise of the constitutional vision of egalitarianism and equality. That rights, fundamental rights are almost they're endowed by the state.
