Is the Commerce Clause Exposed?
The commerce clause power does not grant congress the power to regulate non economic inactivity traditionally within the state's police power. The court says that concerns over separation of power principles casts doubt over the mandate's assertion of virtually unlimited power under guise of a work place regulation. If anybody has this authority under our constitutional federal system, it's the states. It is certainly not the federal government.
