Is There a Split in the Circuit Courts?
There's a split in the circuits. Although the courts that are most involved in copyright, the second and the ninth circuits, have said the rule still stands for old works. The right to terminate section three o four is in the 19 76 act. And therefore we have to use the law of the 1976 act to determine that. There has to be a uniform law across the united states, so it doesn't matter which circuit you're in. So my betting is that they're gong to take this case and hear it some time next fall.
