The prosecutor has to prove a number of things. He's got to prove that civilians are being hit, that they 're being targeted and there is a disproportionate killing or harm to civilians. The prosecutor then has to identify the person or persons who are responsible for that. And that raises a number of questions. It could be the individuals who are actually firing the missiles. Or it could be on instructions, or with reckless abandon that the head of state has ordered all his military to target in that way.
