Justis alido articulates a view that is held by several other members of the court, which is that if the right is not specifically listed or mentioned in the constitution, then it doesn't exist. There's been a lot of criticism of row, even by liberals like the late justice ruth bater ginsburg. Why such criticism? Well, there've been a number of decisions from the supreme court since its founding that have not landed as successfully as perhaps some other decisions. For instance, the brown versus board of education decision in the 19 fifties also was responded to with enormous resistance and back lash from the south.
