The 11th Circuit's Criticism of Aileen Cannon
The standard for recusal in the 11th Circuit is a little bit squishy, but I actually briefed and argued some of these cases to the Circuit in my earlier life as an appellate chief. And when you're looking at a judge and thinking about recusal, the standard really comes down to whether the judge's conduct has been so egregious that for them to continue to participate in the case would undermine public confidence. Whether she has inclined to voluntarily recuse from this case, if it's in fact assigned to her or not, I suspect the court has a lot of interest in preserving its institutional integrity. She will not be the judge who hears this case.
