Does the Major Question's Doctrine Contain Non Delegation?

Is the question whether congress could say the fta can regulate tobacco? Or is the question whether Congress should be forced to choose yes or no. Is there anybody who takes that view? i don't know if we've actually kind of put the rubber to the road on thait oand, and where are you at on thaer?
