CHAPTER

The Supreme Court's Decision in Ren v. Cops

Ren is arguing that the cops here violated the Fourth Amendment, which protects against unreasonable surges and seizures. He says that although the cops claimed they were pulling them over for traffic violations, they actually had no intention of issuing a traffic citation. They also argue that this was racial profiling as the cops had no reason other than their race and their basic location to suspect that they were in possession of drugs at all. Ren: The court rejects all of this; pretext is irrelevant. As long as there is probable cause to pull the vehicle over, it doesn't matter what the real reason for the stop is.
