The Harvard Affirmative Action Brief
The federal government has filed its brief in response to the court's request for the views of the solicitor general and students for fair admissions versus harvard. The brief recommends that the court deny cercerari because, as it notes, the lower federal courts have faithfully applied the court's extant precedente on race in admissions. It also goes on to say the court should not grant cercerari to overrule earlier cases like gruder since the starry decisive factors tilt sharply against overruling.
