There are executive agencies with regulatory power that regularly attempt to do things that Congress has told them they can't do. What is the likelihood that we're going to see something like that with a CBDC? I'm not so sure there's not enough gray area in the legal authority, especially to do what would be called an intermediated CBDC. By the time all that clears, God knows how long that'll be.
