The focus on non-economic personal liberties was primarily on religion because that's what the schools wereprimarily concerned about, he said. He added it made sense at the time when the court was striking down how laws on the basis of economic due process and had not yet assumed its modern-day role as the protector of liberties prescribed in the Bill of Rights.
