You do not need a registered mark in order to prevail in a UDRP provided all the all the other conditions are met. You know, registering your trademark is you automatic proof of it. But certainly I can have a trademark that everybody knows and loves without registering it. If I have a common law mark, the burdens on me to prove that I have acommon law mark. It's pretty clear they knew about it. So, you know, it's a little bit more difficult.
