Debt and Credit in a Community Property State
Debt and credit are very tricky issues, and they can't really be addressed directly in an agreement before marriage. A judge will decide in te divorce decree or proceeding who they think is best able to pay off certain debts. In a community property state, whether it's your debt or your spouse's debt, the court believes that you are going to benefit from that other person's debt. It takes them a long time to re establish their credit.
