The Devil's in the Details
The law will not make it a findable offense if any illegal content gets generated by accident. What they want to see are you are making a good faith effort to implement safeguards in your models that try to say, let's reduce the racist content and so on. We don't know what the dangers of these models are. These seem reasonable but may be entirely ineffective. They may do nothing to prevent the things because we just don't know.
