Is Scalia Still Around?
I think there are some signs that we will talk about in future episodes in more detail that the next court, if it is a five four liberal court, may reign in some of the excesses of the Scalia era. I would put a low probability on the next Supreme Court declaring capital punishment, you know, blanketly unconstitutional. But when you look at Ruth Bader Ginsburg's opinions, for example, I think there is a strong deference to precedent.
