How to Appeal a Sentence in a Tax Case
The government agrees to recommend a sentence of probation in the tax case it's unusual but it is not unheard of. In any federal plea deal the sentencing is carried out by the judge and so the judge even if the government does not make a motion may suispante decide that this case deserves an upward variance from what the sentencing guidelines spit out because sentencing remains in the discretion of the trial judge.
