In the immediate period after president baa's election, democrats technically could have passed legislation codifying rove wade. The first chance they got, and they probably would have gotten that chance before 20 22,. They would have a continued to play hardball with the court and be over turned that codification no matter what happened. There is just no way you could have politically done the math on this issue at any point in the democratic party's history. This isn't just the question of do we cat offywad rov wade? It's about whether or not people can get abortions up till eight months old without getting arrested for it.
