Is There a Place for State Responsibility?

Is there a place for responsibility injustice proceedings, perhaps concurrently with individual criminal responsibility? I believe that when it comes to prosecution of atrocities, that the focus should be on individuals. It doesn't mean not to have state responsibility. But what i'm very concerned about is what happened in a rack after sadam husein was kicked out of coat where this sanctions against the state of a rack just harmed the poor people of a rack who were being victimized by their leader as well.
