How Does a Mitigating Factor Work in Practice?
Mental illness and intellectual disability are very, very rarely brought to the notice of court. The reason for that is lawyers rarely meet these prisoners like their lawyers have rarely met them. They're also difficult for people like lawyers to detect. We need a system which allows people skilled in that knowledge to be able to diagnose somebody with mental illness or intellectual disability, so that the lawyer can then present it to courts. But we don't have a system like that. In what we are trying to do is to say, get social workers, get sociologists, involved in legal representation,. because that is the only way you can actually do that searching inquiry into someone's case.
