The Role of Standing in the Court's Decision on the Rights Owned Terms
John Avlon: Justice Kagan's dissent in this case is interesting and in some ways a real compliment to the conservative legal movement. He says he doesn't find her arguments persuasive, but she does take more seriously the premises of the majority opinions. Avlon: The court has been inconsistent on standing, mootness and ripeness; I wish they were more consistent about it.
