There is enough evidence that this can reasonably be put in front of a jury. If the plaintiffs had no evidence at all and no likelihood of producing any such evidence, then the drugg judge would be obligated to dismiss. But there actually seems to be substantial evidence tha fox kept on broadcasting these allegations with no basis at all for believing that they were true. To repeatedly broadcast such damaging allegations when you've got no reason to think that they are true probably rises to the standard of recklessness.
