The Commerce Clause and Violence Against Women
In a 5-4 decision, the Supreme Court said no to victims of gender-based violence being able to sue for damages in federal court. In 1994, Congress passed the Violence Against Women Act that provided funding for the investigation and prosecution of domestic violence. This case is one of the many times that conservatives on the court have made up a new and arbitrary rule to try to limit the ability of Congress to legislate with the goal of hampering progressive legislation.
