Trademark law exists to protect consumers against being duped or tricked into buying goods or services under the mistaken assumption that they are being offered by someone other than the person actually offering. The argument here, which there seems to be some support for, is that people assume that Hermes had entered the metaverse and was putting out these meta-burkins. We are only on day three of the trial, but there has been testimony that one Hermes executive was teaching a class at Columbia University in New York City.
