The supreme court is actually required by federal law to retain this appearance of impartiality. There is a federal statute that requires justices to recuse when their impartiality could be reasonably questioned, but there's no one to enforce that rule and so the justices can just ignore it. And it is highly unusual, really unprecedented, to have the spouse of a justice this engaged in political actavism.
