The Polarization of the Lower Federal Courts
The MIFA-Pristone case is just sort of the most visible example where plaintiffs who have no plausible claim to stand in under long settled precedents find the friendliest district judge they can think of. That lawsuit like that setup is going to keep repeating itself until the Supreme Court says that's enough, right? So what we're looking at then is for whenever we have a democratic administration, its policies are going to be subject to second guessing and undoing in the federal courts.
