Two years ago, as Donald Trump is getting ready to leave office, they had a series of internal meetings where they consider, do we charge this case federally? We know the outcome was no. The Southern District believed that the crimes here were not at the highest level of seriousness. It would be extraordinarily difficult to prosecute a former president who is politically both very popular and very unpopular.
