The 14th Amendment and the Slaveryhouse Cases
The 14th Amendment established citizenship rights for the first time and equal protection to former slaves. Constitutional constructions can be interpreted broadly or narrowly, depending on the cultural consensus of the day. The years 1897 to roughly 1930 known as the Lochner era in legal history because court used substantive due process to protect businesses from state regulation.
