Justice Barrett said essentially, you know, she accepted that the Voting Rights Act had been amended in 1982 to go beyond intentional discrimination claims. She also accepted that the use of race was permissible to remedy racial discrimination. And so if you accept both of those premises, then really Alabama doesn't have an argument because if facially neutral rules can still violate the Voting rights Act, then plaintiff's win.
