The odds that he doesn't assert privilege are basically zero. He's not like on a hot streak there in court, he has tried that with multiple witnesses to the January 6th grand jury and lost. And I think you're right that the court could very well say, yeah, that's not enough to override the president's, the former president's interest in not having to testify.
