The Legal Positivism of Dr. King
Dr. King says we can't simply look to some human authority to determine whether the law is just or unjust. In 1963, what was happening in Birmingham, Alabama was perfectly legal under the positive law. If he had taken his case to the US Supreme Court, he would have lost. He's trying to claim that there are principles that are knowable by human beings in general.
