Is the ADA Really New?

The ADA is often pointed to like this, but there has to be some innovative or at least more aggressive aspect to it. There's an idea that in some context a non-governmental person can come in and sort of stand in the shoes of the government. And you have right now, I'm just making it up, but you have probably easily a couple hundred of those kinds of cases working their way through the courts as one time or another.
