The Fifth Circuit's Decision to Grant Cert on the Supreme Court's Case
I think there are at least three justices who would vote to uphold this law. The question of course is whether the court's going to take cert on it. It takes five votes to issue a stay and only four to grant cert. And so I think the real question is will either Roberts or Kavanaugh join with Alito, Gorsuch, and Thomas? Or will they back off and this will go away for now?
