In 2008, evidence emerges that a number of high value detainees at Guantanamo had in fact produced evidence that was relevant to Ozerra's case. And the new evidence is that these individuals at Guantanamo basically dispute the record about what was alleged and proven by the jury against Ozerra. Judge Stein decided that Uzerra would be able to argue on retrial not only that he never knowingly aided the terrorist group, but that he never aided al-Qaeda at all.
