The Justice Department's Role in the Contempt Act
Bannon referred to the Justice Department for contempt of congress. The department often does not prosecute these contempt cases, particularly when they are directed at an official following a privilege claim. But there are times when the executive branch considers it something of a commity obligation to congress to actually prosecute contempts of congress. There's very little institutional sympathy in the justice department for, for Congress.
