The High Court's Decision on the Duty of Care of the Police
In general, the police don't owe a duty of care for a failure to act or a failure to prevent harm caused by criminals. The High Court said that this was one of those mythical, special exceptional cases where there was a positive duty to warn. Public policy historically has been a very significant factor, which led the courts to decide that the police shouldn't be liable. In this case they said that public policy actually means abuse women should be protected.
